Terms of Service

These Terms of Service govern your use of the CMB Hire Pty Ltd website at cmbhire.site and any hire agreement formed between you and CMB Hire Pty Ltd for the hire of equipment or vehicles. By using this website, requesting a quote, or entering into a hire agreement with us, you agree to these terms.
1. Who We Are
CMB Hire Pty Ltd (ABN 85 702 123 073) is a Western Australian company providing equipment and vehicle hire services to customers throughout Perth, WA. References in these terms to "we", "us" and "our" mean CMB Hire Pty Ltd. References to "you" mean the customer named in a hire agreement or booking.
2. Quotes and Bookings
Quotes provided by us are estimates based on the information you supply and are valid for 14 days unless otherwise stated in writing. A booking is confirmed only when we accept your request and, where applicable, receive any required deposit. We reserve the right to decline any booking at our discretion, including where equipment or vehicles are unavailable.
3. Hire Agreements
Each hire of equipment or a vehicle is governed by a hire agreement entered into at or before the commencement of the hire period. Where a hire agreement conflicts with these terms, the hire agreement prevails to the extent of the inconsistency. You must be at least 21 years of age and hold a valid Australian driver licence (or equivalent recognised licence) to hire vehicles or to operate towable or plant equipment.
4. Payment, GST and Security Bonds
Hire charges are payable in Australian dollars and are quoted inclusive or exclusive of GST as stated at the time of quoting. Payment is due in accordance with the hire agreement. We may require a security bond or pre-authorisation before commencement of hire. Bonds are refunded within a reasonable time after the return of equipment or vehicles in the agreed condition, less any amounts owed for damage, loss, cleaning, fuel or late return.
5. Hire Period, Delivery and Collection
The hire period commences at the time stated in your hire agreement and ends when equipment or vehicles are returned to, and accepted by, us or collected by us. Delivery and collection services may be offered within our Perth service areas at additional charge, subject to availability. You are responsible for ensuring safe and lawful access at the delivery and collection point.
6. Your Responsibilities During Hire
During the hire period you must:
- use equipment and vehicles only for their intended purpose and in accordance with any instructions, manuals or safe operating guidelines we provide;
- comply with all applicable laws, including road rules, licensing, load limits and workplace safety requirements;
- keep equipment and vehicles secure when not in use;
- not sub-hire, part with possession of, or modify the equipment or vehicles without our prior written consent;
- promptly notify us of any fault, damage, breakdown, theft or incident involving the hired item.
7. Damage, Loss and Cleaning
You are responsible for all damage to, and loss or theft of, hired equipment and vehicles during the hire period, except for fair wear and tear. You must return items in a clean condition; additional cleaning fees may apply where items are returned unclean. Where a vehicle is returned without the agreed fuel level, refuelling charges may apply.
8. Cancellations, Extensions and Returns
Cancellation fees may apply where a confirmed booking is cancelled with less than 24 hours' notice. If you wish to extend a hire period, you must seek our approval before the original end time; extensions are subject to availability and additional charges. Early returns of equipment or vehicles do not entitle you to a refund of prepaid hire charges unless we agree otherwise in writing.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other legislation that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For goods of a kind ordinarily acquired for personal, domestic or household use, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
10. Limitation of Liability
To the extent permitted by law, and except as required under the Australian Consumer Law, we are not liable for any indirect, incidental or consequential loss arising from your use of this website or of our hired equipment and vehicles. Where liability cannot be excluded and is attributable to us, our total aggregate liability is limited, at our election, to the resupply of the relevant goods or services or the cost of resupplying them.
11. Website Content and Intellectual Property
All content on this website, including text, images, branding and layout, is owned by or licensed to CMB Hire Pty Ltd and is protected by intellectual property laws. Content on this website is general in nature and is provided for information only; it does not constitute professional advice and may change without notice. You may not reproduce or reuse website content without our written permission.
12. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms.
13. Governing Law
These terms and any hire agreement are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
